Do I need a building permit for my Cabin or Patio?
Generally a building permit is required for any cabin or patio over 10 square metres and above 2.4m in total height.
If the patio is attached to another structure, it will need a permit regardless of the size.
A permit is also needed for a raised deck which is more than 500mm from the ground.
An open roofed pergola can be up to 20 square metres without a permit, even if it joins a building.
How to apply for a Building Permit:
The process for obtaining a building permit can be quite lengthy and time consuming, which is why it’s best to leave all the paperwork to us! We can help with providing detailed plans, liaising with the council on your behalf, engineer certification and site plans. We work closely with a building surveyor, who provides a Certificate of Design Compliance for each project. This fast-tracks the application procedure, shortening the council processing time down from 30 days to 10 days.
Planning Approval:
In some cases planning approval is also required. This is generally only needed if you are choosing to build closer to your boundary than what the council allows. We can help with this application process also, giving you time to focus on more important things (like deciding what type of furniture you’d like for your new patio or cabins!). If planning approval is required, there will be longer processing times from the council.
Why is it so important to have a building permit?
The requirement for a building permit is to make sure that all new buildings comply with the Building Code of Australia. Can you imagine if any person was allowed to go around nailing bits of timber together and hoping for the best? The Building Code of Australia sets very strict standards on how to build structures which are not only safe for the occupants but will endure and last.
As registered builders, we make sure all of our projects meet and exceed the building code. If you start building a large patio or cabin without a permit, the council has a right to issue a stop work order, and even make you tear the structure down after it has been constructed.
Unapproved structures can also cause issues with house insurance and make it difficult if you wish to sell your property in the future.
What structures don’t require a permit?

- Re-roofing or re-thatching
- Decking under 500mm in height
- Freestanding patios under 10sqm and 2.4m in height
- Freestanding cabins under 10sqm and 2.4m in height
- Pergolas (attached or freestanding) under 20sqm and 2.4m in height
- Bali Umbrellas under 2.4m in height
